MYTHS ON POWER OF ATTORNEY

by dextos | Nov 9, 2024 | Uncategorised | 0 comments

Here are common myths about a Power of Attorney.

1. A POA is just an instruction, and you don’t need a lawyer when preparing it. This is a boat sinking myth as every single word in a POA can make or mar the Principal. A legal guide is infact the first step to seek when preparing one.

2. A  POA does not transfer ownership of assets. The agent’s authority is to manage and make decisions about the principal’s affairs, but ownership remains with the principal, and the agent must act in the principal’s best interest only.

3. A POA is not a limitless authority. Contrary to the myth that it grants unlimited power, a POA is a legal document that designates someone to make specific decisions on behalf of the principal. It does not provide the agent with the right to act beyond the scope outlined in the document.

4. Another misconception is that a POA lasts indefinitely. In reality, POAs can have specific durations or conditions that terminate them, such as the principal’s incapacitation. It’s crucial to understand the terms and limitations of the document.

5. POA does not survive death. However, the authority granted by a POA ceases upon the principal’s death. After that point, decisions are typically handled by an executor named in the principal’s will or according to state laws.

6. Revocability misconception: Contrary to the belief that a POA is irrevocable, many POAs are, in fact, revocable. The principal can revoke or amend the POA at any time, provided they are of sound mind. This flexibility allows individuals to adapt the document to changing circumstances.

7. Absence of accountability: The agent under a POA is not immune to accountability. They must act in the principal’s best interest and adhere to legal and ethical standards. Misuse of power can lead to legal consequences, emphasizing the importance of selecting a trustworthy and responsible agent.

It’s important to dispel these myths to ensure a clear understanding of the purpose and limitations of a Power of Attorney, promoting informed decision-making and safeguarding the interests of all parties.
